These Terms of Use (“Terms”) govern your access to and use of www.roybaltravels.com (the “Site”).

The Site is operated by Happy Trails Media LLC, a Colorado limited liability company (“Happy Trails Media” or “HTM”). References to “we,” “us,” or “our” mean Happy Trails Media with respect to operation of the Site and, where the context concerns a separately provided service, the applicable service entity identified in these Terms.

The Site showcases creative and media work, provides information about Happy Trails Media and its services, allows prospective clients to contact us or request consultations, supports quotes, invoices, and payments for certain services, and provides ways to request an initial travel-advisor consultation and a free introductory business-consulting consultation.

Certain travel-advisory services accessible through the Site are provided separately through Roybal Hawk Travel LLC in connection with its relationship with Fora Travel. Additional terms from Fora Travel, travel suppliers, and other third parties may apply to those services.

Certain business-consulting services accessible through the Site are provided separately and exclusively by Roybal Hawk LLC, a Colorado limited liability company. A consultation request through the Site does not make Happy Trails Media the provider of those services.

By accessing or using the Site, you acknowledge these Terms and agree to comply with them. If you do not agree with these Terms, you should not use the Site.

1. Purpose of the Site
The Site provides information concerning Happy Trails Media, Roybal Hawk LLC, Roybal Hawk Travel LLC, their respective services, creative work, projects, and related business activities.

The Site may be used to:

View creative portfolios, videos, photography, designs, articles, and other content
Learn about Happy Trails Media and available services
Contact Happy Trails Media
Request or schedule consultations
Submit project inquiries
Request information concerning potential services
Receive or access quotes, proposals, invoices, or payment requests
Make payments through available payment providers
Subscribe to certain communications
Request an initial travel-advisor consultation
Request a free introductory business-consulting consultation
Access other features that we may make available

The availability of information or a service on the Site does not guarantee that we will accept a particular project, engagement, booking, or business relationship.

2. Eligibility and Authority
You may browse the Site for lawful informational purposes.

To purchase services, make payments, enter into agreements, or otherwise create legally binding obligations through or in connection with the Site, you must have the legal capacity to do so.

If you use the Site on behalf of a company, organization, or other legal entity, you represent that you have authority to act on behalf of that entity with respect to the applicable transaction.

3. Happy Trails Media Services
Happy Trails Media may offer services including, but not limited to:

Video production
Photography and still imagery
Commercial and promotional content
Digital content creation
Creative development
Graphic and visual design
Logos
Business cards and marketing collateral
Strategic marketing services
Related creative or media services

Descriptions appearing on the Site are general descriptions and do not constitute a guarantee that a particular service, deliverable, price, schedule, result, or scope of work will be available.

Specific services may require a separate written agreement, proposal, statement of work, quote, estimate, invoice, booking confirmation, or other transaction-specific documentation.

4. Separate Client Agreements Control
These Terms govern general use of the Site.

They do not replace a project- or service-specific agreement between a client and Happy Trails Media, Roybal Hawk LLC, Roybal Hawk Travel LLC, or another applicable provider.

A particular engagement may be governed by additional terms contained in a:

Service agreement
Business-consulting agreement
Production agreement
Statement of work
Proposal
Quote
Estimate
Invoice
Booking confirmation
Licensing agreement
Release
Other written agreement

If a transaction-specific agreement expressly conflicts with these Terms concerning that transaction, the transaction-specific agreement controls to the extent of that conflict.

Nothing on the Site by itself requires Happy Trails Media, Roybal Hawk LLC, Roybal Hawk Travel LLC, or another service provider to accept a proposed project or enter into a client relationship.

5. Quotes, Estimates, Invoices, and Payments
The Site and Wix services may be used by Happy Trails Media or Roybal Hawk LLC to prepare, transmit, access, or administer quotes, estimates, invoices, and payments.

Prices and other financial information displayed in a particular quote, proposal, invoice, or agreement apply only to the transaction identified in that document unless otherwise stated.

Applicable taxes, fees, expenses, deposits, retainers, payment schedules, cancellation provisions, refund provisions, late-payment provisions, and other financial terms may be stated separately in the applicable agreement, quote, invoice, or other transaction documentation.

Payments may be processed through Wix and third-party payment providers, including payment methods made available through those services.

By initiating a payment, you agree to provide accurate and authorized payment information and to comply with the applicable payment provider's terms.

Happy Trails Media does not guarantee that every payment method will remain available at all times.

Refund and cancellation rights, if any, are governed by the applicable transaction-specific terms, Section 8 below for consultation bookings, and applicable law. These Terms do not otherwise create a general right to a refund.

6. Travel-Advisor Consultations
The Site provides a way to request or schedule a free initial travel-advisor consultation with Ryan.

The booking functionality on roybaltravels.com is primarily an initial contact and scheduling mechanism.

If you proceed with travel-advisory services, those services may be provided separately through Roybal Hawk Travel LLC in connection with its relationship with Fora Travel.

The actual travel-advisory relationship may therefore involve separate:

Communications
Systems
Forms
Agreements
Privacy notices
Payment arrangements
Supplier terms
Booking conditions
Cancellation policies

provided by Roybal Hawk Travel LLC, Fora Travel, or the applicable travel supplier.

Airlines, hotels, cruise lines, tour operators, transportation companies, insurance companies, payment processors, and other travel suppliers are independent third parties and may impose their own terms and conditions.

The existence of a consultation request or appointment through the Site does not itself constitute a confirmed reservation, travel booking, supplier contract, or guarantee of price, availability, admission, transportation, accommodations, or other travel services.

7. Business-Consulting Consultations
The Site provides a way to request or schedule a free introductory business-consulting consultation with Ryan.

Roybal Hawk LLC is the sole provider of those business-consulting services. Happy Trails Media operates the Site and Wix booking flow but does not provide the business-consulting service.

Business-consulting services may include:

Business-model development
Organizational structure and decision-making roles
Roles and responsibilities
Operating systems and workflows
Pricing, budgeting, cash-flow analysis, and financial scenario planning for a business or project
Feasibility and risk analysis
Project planning
Marketing strategy
Implementation roadmaps

Roybal Hawk LLC does not provide personal financial planning; investment, securities, or trading advice; legal, tax, or accounting advice; bankruptcy, credit-repair, insurance, or lending advice.

Business budgeting, cash-flow analysis, and financial scenario planning are limited to strategic analysis of a business or project and are not personal financial or investment advice. You remain responsible for business decisions and for consulting appropriately licensed legal, tax, accounting, financial, insurance, or other professionals when needed.

Scheduling or participating in an introductory consultation does not create an attorney-client, accountant-client, fiduciary, investment-advisory, brokerage, insurance, lending, or other regulated professional relationship. It also does not require Roybal Hawk LLC to accept a continuing engagement.

If the parties proceed beyond the introductory consultation, the engagement may require a separate consulting agreement, proposal, statement of work, confidentiality agreement, invoice, or other written documentation. That documentation controls the engagement to the extent it conflicts with these general Terms.

8. Consultation Cancellation and Rescheduling
Cancellations made at least 24 hours before the scheduled consultation may be rescheduled or, if payment was collected for the consultation, refunded. Cancellations made less than 24 hours before the consultation are non-refundable.

The introductory business-consulting and travel-advisor consultations currently offered through the Site are free, so the refund provisions do not apply unless a future consultation requires payment. Rescheduling and replacement bookings remain subject to availability.

A missed consultation without prior cancellation may require a new booking and is subject to availability.

9. Travel Information and Third-Party Suppliers
Travel information, prices, schedules, entry requirements, availability, transportation conditions, supplier policies, and other travel-related information can change.

Information provided through the Site or during an initial consultation should not be interpreted as a guarantee that particular travel arrangements, prices, routes, accommodations, attractions, or services will remain available.

Travelers are responsible for complying with applicable requirements concerning matters such as:

Passports
Visas
Immigration
Customs
Entry and exit requirements
Health or vaccination requirements
Travel documentation
Local laws
Supplier requirements

to the extent applicable to their trip.

Where travel arrangements are provided through independent suppliers, those suppliers are responsible for performing their own services subject to their applicable agreements and law.

Nothing in these Terms limits any responsibility that cannot lawfully be excluded or limited.

10. No Guarantee of Creative, Business, or Marketing Results
Happy Trails Media may provide creative, production, advertising, branding, content, or strategic marketing services. Roybal Hawk LLC may provide business and project consulting.

Creative and marketing outcomes depend on numerous factors outside our control.

Unless expressly guaranteed in a separate written agreement, we do not guarantee:

A particular number of views, impressions, followers, subscribers, or engagements
Sales or revenue increases
Lead generation
Advertising performance
Search-engine rankings
Social-media growth
Media coverage
Public recognition
Awards
Distribution
Virality
Business opportunities
Any specific commercial or creative result
Business viability, profitability, revenue, cash flow, cost savings, or financing
Acceptance by lenders, investors, regulators, customers, partners, or other third parties
A particular legal, tax, accounting, licensing, insurance, credit, or regulatory outcome
Successful implementation of a recommendation, strategy, plan, system, or roadmap

Examples, portfolios, case studies, prior work, projections, forecasts, analyses, recommendations, and discussions of potential outcomes are not guarantees of future performance.

11. Intellectual Property
Unless otherwise indicated, the Site and its content are owned by, licensed to, or lawfully used by Happy Trails Media, Roybal Hawk LLC, or the applicable rights holder and are protected by applicable intellectual-property laws.

Videos
Films
Audio
Graphics
Illustrations
Logos
Designs
Written material
Articles
Marketing materials
Website designs
Branding elements
Project names
Creative concepts
Consulting frameworks and methods
Templates, workbooks, and planning tools
Analyses, recommendations, and strategic materials
Other original material

Certain portfolio material may be owned by clients, collaborators, licensors, photographers, artists, performers, or other third parties and displayed with permission or pursuant to applicable rights.

Your access to the Site or participation in an introductory consultation does not transfer ownership of any intellectual property to you. Ownership and permitted use of client-specific deliverables are governed by the applicable written agreement.

Subject to these Terms, you may view the Site for lawful personal or internal business purposes.

Unless authorized in writing by the applicable rights holder or permitted by applicable law, you may not:

Reproduce Site content
Republish Site content
Sell or commercially exploit Site content
Modify or create unauthorized derivative works from Site content
Remove copyright, trademark, or ownership notices
Present Site content as your own
Use Happy Trails Media branding in a manner suggesting an unauthorized affiliation or endorsement
Download or systematically copy substantial portions of the Site
Use Site content to train, develop, or improve artificial-intelligence or machine-learning models without written authorization
No rights are granted except those expressly provided in these Terms or required by applicable law.

12. Trademarks and Branding
Names, logos, trade dress, slogans, graphics, service names, project names, and other branding displayed on the Site may be trademarks, service marks, or other protected identifiers belonging to Happy Trails Media or third parties.
Nothing on the Site grants permission to use those marks except with the prior authorization of the applicable owner or as otherwise permitted by law.

13. Information and Materials You Submit
You are responsible for information and materials you voluntarily submit through the Site.

You represent that you have the authority and necessary rights to provide materials you submit to us and that your submission does not knowingly violate another person's rights or applicable law.

When you submit materials for the purpose of requesting a consultation, quote, project review, or service, you authorize Happy Trails Media and the applicable service entity to use those materials to the extent reasonably necessary to:

Review your inquiry
Communicate with you
Evaluate a potential engagement
Review and analyze requested business or project records
Prepare a quote or proposal
Provide requested services
Administer the resulting business relationship

This limited permission does not transfer ownership of your materials to Happy Trails Media, Roybal Hawk LLC, or another applicable service entity.

Personal information contained in submissions is handled as described in our Privacy Policy.

14. Confidential and Proprietary Information
Do not submit trade secrets, confidential business information, unreleased proprietary material, or other highly sensitive information through a general Site contact or booking form unless we have established an appropriate method for receiving that information.

When requested for a business-consulting consultation or engagement, you may submit business plans, budgets, financial statements, organizational charts, policies, procedures, workflow materials, and similar records through a designated Wix upload field or Google-based file-sharing method.

Before submitting records, remove or redact unnecessary Social Security numbers, personal tax-identification numbers, full account or routing numbers, credentials, health information, and personal information concerning employees, customers, vendors, or other third parties. You represent that you have the authority and necessary rights to share the submitted information.

Use of a designated upload method does not by itself create confidentiality obligations beyond those stated in the Privacy Policy or a separate written agreement. If heightened confidentiality is important, the parties should establish those obligations in writing before sensitive material is submitted.

Submission of an inquiry through the Site does not by itself create a confidential, fiduciary, attorney-client, agency, or other special relationship.

If confidentiality is important to a proposed project, appropriate confidentiality obligations should be established separately in writing.

15. Unsolicited Creative Ideas
Happy Trails Media operates in creative industries and may independently develop projects, concepts, themes, designs, stories, marketing ideas, videos, photographs, branding, and other creative material.

To reduce disputes regarding independently developed ideas, please do not submit unsolicited scripts, treatments, concepts, story ideas, campaign concepts, creative pitches, or other proprietary creative material unless we have specifically requested the submission or agreed in writing to review it.

Unless we expressly agree otherwise in writing, the submission of an unsolicited creative idea does not create an obligation to:

Review the material
Keep the idea confidential
Develop the idea
Enter into a business relationship
Pay compensation for the idea

Nothing in this section gives Happy Trails Media ownership of copyrighted material or other intellectual property belonging to you.

16. Acceptable Use
You agree not to misuse the Site.

You may not knowingly:

Use the Site for unlawful, fraudulent, deceptive, abusive, or malicious purposes
Impersonate another person or organization
Submit false or misleading information
Attempt unauthorized access to the Site, accounts, systems, servers, or networks
Interfere with Site security or functionality
Introduce malware, malicious code, viruses, or harmful technology
Circumvent security or access controls
Conduct unauthorized vulnerability testing
Use automated systems to scrape, harvest, or systematically extract Site content or personal information without authorization
Use Site content in a manner that infringes intellectual-property or privacy rights
Use the Site to harass, threaten, defame, or unlawfully harm others
Use the Site to distribute spam or unauthorized commercial communications
Attempt to interfere with other visitors' use of the Site
Use the Site in violation of applicable sanctions, export controls, or other applicable laws

We may restrict or terminate access to the Site where reasonably necessary to protect the Site, our business, our users, or others.

17. Third-Party Services
The Site relies on or may interact with third-party platforms and providers.

These may include, among others:

Google services, including Google Workspace, Gmail, Calendar, Meet, Drive, Docs, and Gemini or other AI-enabled features
Usercentrics
Meta / Facebook / Instagram
PayPal
Apple Pay
Google Pay
Fora Travel
Travel suppliers
Other technology, advertising, payment, communication, or service providers

Third-party services are governed by their own terms, privacy policies, and operating rules.

Happy Trails Media does not control the independent terms or privacy practices of those third parties.

Your use of a third-party service may create a separate legal relationship between you and that provider.

18. Third-Party Links
The Site may contain links to websites, social-media profiles, booking systems, payment systems, travel providers, or other resources operated by third parties.

A link does not necessarily constitute an endorsement of the third-party operator, its products, its services, or its content.

We are not responsible for the independent content, security, availability, terms, privacy practices, or operation of third-party websites and services.
You access third-party resources at your own discretion and subject to their applicable terms.

19. Copyright and Intellectual-Property Concerns
We respect the intellectual-property rights of others.

When you contact us electronically, submit a form, request a consultation, receive a quote or invoice, or otherwise conduct business with us electronically, you consent to receiving communications reasonably necessary to respond to or administer that interaction electronically.

Payment confirmations
Contract-related communications
Service notices
Administrative communications

Consent to receive transactional or service-related communications does not automatically constitute consent to receive promotional email or automated marketing messages where separate consent is required by law.

22. Consultation Recordings, Transcription, and AI-Assisted Features
Consultations may be conducted through Google Meet or other Google services and may support recording, transcription, automated note-taking, and AI-assisted analysis.

Before a consultation is recorded or transcribed, or an automated meeting feature requiring consent is activated, participants will receive notice and be asked to provide affirmative consent. If consent is not provided, the feature will not be used.

By affirmatively consenting, you authorize the applicable service entity and its Google service providers to capture and process your voice, image, statements, shared-screen content, meeting metadata, and submitted materials for purposes of documenting, evaluating, administering, or performing the requested service.

AI-assisted notes, summaries, analyses, recommendations, and draft work product may contain errors, omissions, or incomplete interpretations. They are assistive materials, may be reviewed or corrected, and do not replace professional judgment or advice from an appropriately licensed professional.

The collection, use, storage, retention, and disclosure of these materials are governed by our Privacy Policy and the applicable third-party provider terms and privacy notices.

23. Site Availability and Changes
We may modify, update, suspend, remove, or discontinue portions of the Site at any time.

We do not guarantee that:

The Site will always be available
The Site will operate without interruption
Every feature will remain available
Content will always be current
The Site will be free from technical errors

We may correct errors, update information, modify service descriptions, and change Site functionality without prior notice where permitted by law.

24. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND GENERAL INFORMATION AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

CONSULTATIONS AND GENERAL STRATEGIC INFORMATION AVAILABLE THROUGH THE SITE ARE PROVIDED FOR INFORMATIONAL AND BUSINESS-PLANNING PURPOSES, SUBJECT TO ANY SEPARATE WRITTEN AGREEMENT.

HAPPY TRAILS MEDIA AND ROYBAL HAWK LLC DISCLAIM WARRANTIES REGARDING THE SITE, FREE INTRODUCTORY CONSULTATIONS, AND GENERAL INFORMATION THAT ARE NOT EXPRESSLY PROVIDED IN A SEPARATE WRITTEN AGREEMENT, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR FREE FROM HARMFUL COMPONENTS.

THIS SECTION DOES NOT ELIMINATE WARRANTIES, GUARANTEES, OR OTHER RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED.

Paid services may be governed by separate warranties or obligations contained in the applicable service agreement or other transaction-specific documentation.

25. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HAPPY TRAILS MEDIA AND ROYBAL HAWK LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING SOLELY FROM ACCESS TO OR USE OF THE SITE OR PARTICIPATION IN A FREE INTRODUCTORY CONSULTATION, INCLUDING LOSS OF DATA, BUSINESS INTERRUPTION, OR LOSS OF PROFITS, EVEN IF THE POSSIBILITY OF SUCH DAMAGES WAS KNOWN.

This limitation concerns use of the Site and free introductory consultations. It does not replace liability provisions contained in an applicable client, production, business-consulting, travel, or other transaction-specific agreement.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

26. Indemnification
To the extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities, or expenses arising from:

Your unlawful misuse of the Site
Material you submit without sufficient rights or authorization
Your infringement of another person's intellectual-property or other legal rights
Your material violation of these Terms

This provision does not require you to indemnify Happy Trails Media or Roybal Hawk LLC for conduct for which indemnification would be prohibited by applicable law.

27. Compliance With Laws and Restricted Transactions
The Site may be accessible from locations throughout the world.

Access to the Site does not mean that Happy Trails Media is legally permitted or obligated to provide services in every jurisdiction.

We may decline or restrict a transaction, engagement, payment, project, consultation, travel arrangement, or service where reasonably necessary to comply with:

United States sanctions
Export controls
Trade restrictions
Financial regulations
Local licensing requirements
Applicable laws or regulations
Restrictions imposed by payment processors or other service providers

You are responsible for using the Site in compliance with laws applicable to you.

28. International Users
The Site is operated from the United States.

If you access the Site from another country, you are responsible for compliance with applicable local laws.

Nothing in these Terms is intended to deprive a consumer of mandatory protections that cannot lawfully be waived under the laws applicable to that consumer.

29. Governing Law
Except where mandatory law requires otherwise, these Terms and disputes relating to general use of the Site are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

30. Dispute Resolution and Venue
Before initiating formal legal proceedings concerning these Terms or general use of the Site, we encourage you to contact us at:

so the parties can attempt to resolve the issue directly.

Except where applicable law requires otherwise, any legal proceeding relating to these Terms or general use of the Site shall be brought in a court of competent jurisdiction located in or serving El Paso County, Colorado, and the parties consent to the jurisdiction of those courts.

A separate client agreement, supplier agreement, or travel-related agreement may contain different dispute-resolution provisions. Where applicable, those transaction-specific provisions control the dispute arising under that agreement.

31. Termination or Restriction of Access
We may restrict, suspend, or terminate access to the Site where we reasonably believe a user:

Has materially violated these Terms
Is using the Site unlawfully
Is attempting to compromise Site security
Is interfering with other users or our systems
Presents a reasonably identifiable security, fraud, or legal risk

Termination of access does not affect rights or obligations that arose before termination.

32. Changes to These Terms
We may update these Terms from time to time to reflect:

Changes to the Site
Changes to our services
New features
Changes to our business practices
Changes in applicable law
Changes involving third-party providers
Other operational or legal developments

When we update these Terms, we will revise the Last Updated date at the top of this page.

Where applicable law requires additional notice or affirmative consent to a material change, we will provide such notice or obtain consent as required.

33. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary where permitted by law, and the remaining provisions will continue in effect.

34. No Waiver
Our failure to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision or another provision in the future.

35. Assignment
You may not assign or transfer rights or obligations arising under these Terms without our written consent where such consent may lawfully be required.

Happy Trails Media may assign rights or obligations relating to the Site in connection with a merger, acquisition, restructuring, sale of assets, reorganization, or similar business transaction, subject to applicable law.

36. Entire Agreement Regarding Website Use
These Terms, together with the policies expressly referenced in them, constitute the general agreement concerning use of the Site and initial consultations made available through it.

They do not replace separate agreements governing:

Paid creative or media services
Production projects
Business-consulting services and deliverables
Licensing
Client deliverables
Travel-advisory services
Travel bookings
Third-party services
Other transactions requiring separate terms

Those agreements remain independently enforceable according to their terms.
